1. 1. This represents the Rental Agreement between Renter and SBZ Group Pty Ltd.
   2. It states the Terms & Conditions for the renting of CarOne or contract with CarOne Rentals.
   3. The duration of Rental Contract is specified on the Rental Agreement.
   4. Endeavour to read our Terms and conditions before putting up an application via our online Portal carone.com.au or in person. If you have any question or need further clarification, try and contact us by sending a request through our online form.
   5. The following terms are used in the contract:
   6. SBZ Bank Account:
      1. Bank ACCOUNT DESIGNATED for Payment: Common Wealth Bank
      2. Name: SBZ Group Pty Ltd.
      3. BSB: 062903
      4. Account: 10915183
   7. Administration fee: Administrative cost charge associated with your rental.
   8. Bond Deposit: 700$ security bond paid at the commencement of rental agreement.
   9. Accident: Unforeseen incident that can cause the vehicle to damage or require fixing.
   10. Authorised Driver: Any driver approved in the agreement.
   11. Claim administration fee. A 100$ fee charged for processing insurance claim for fixing. damaged car.
   12. Car One Rentals: Trading name of SBZ Group Pty LTD ACN: 613958562.
   13. Rental Charges: Charges Plus GST applicable shown in the rental Agreement.
   14. Rental Period: Period of Rent shown in Rental Agreement or extended.
   15. WE , US, Our: Indicates SBZ Group Pty Ltd or “Car One Rental”
   16. You, Your: Indicates anyone renting a car and designated to drive during the rental agreement.
   17. Renter: A Person who signs a rental agreement to rent a car.
   18. Final Inspection: Inspection done at the end of rental period.
   19. Access: 1000$ paid in the event of accident or damage for insurance claim.
   20. Credit Card: Credit card information given by the renter at the commencement of rental agreement.
   21. Renter must drive the car himself, any additional access in the event of accident will be renter’s responsibility.
   22. You MUST return the vehicle at the end of rental period to a designated location as advised.
   23. If you require vehicle for an extended period, you must notify us at least 1 week prior to the end of your rental period or at the earliest convenience.
   24. At the end of the rental agreement, car must be cleaned fuelled otherwise its monetary cost shall be deducted from bond.
   25. Termination fee applies if you return the vehicle before the end of rental period.
   26. If remaining rental PERIOD IS more or EQUAL TO 4 weeks, then minimum four weeks rental applies.
   27. If rental period is less than 4 weeks, then remaining rental days applies.
   28. If you don’t return the vehicle at the end of rental period, weekly RENTAL WILL apply @ minimum weekly rental in the contract or advised at the time.
   29. We may terminate the Rental Contract and take immediate possession of the Vehicle if you violate Rental Contract; or violate road or traffic legislation.
   30. If the Rental Contract is terminated, you must pay for
   31. Damage
   32. Loss of the vehicle as a result of theft
   33. Third Party Loss
   34. Storage, repossession and recovery fees
   35. Fees for the release of the Vehicle from compound
   36. Roadside assistance
   37. Administrative and legal costs of recovery and Rental charges
   38. 700$ Bond is required as a deposit at the commencement of rental period.
   39. 200$ administration fee deducted from bond applies to all rental agreements.
   40. Driver will maintain deposit of 700$ during the entire rental period.
   41. 500$ Bond will be refunded to a designated account after the end of rental period. It takes 10 Working days to process refund.
   42. Bond deposit is subject to deduction in the event of rental arrears or car damage.
   43. 1000$ access applies to all accidents or Insurance claims more than 1000$
   44. 1500$ Access applies to all accidents for drivers under the age of 25 years.
   45. If access is not paid, we shall deduct from the bond and $500 from designated credit card.
   46. Driver if vindicated shall not incur 1000$ access fee.
   47. There is a limit of 1300KM/Week. A driver incurs additional charge of 15c/km which is deducted at the end of the rental period.
   48. In the event of accident, mechanical fault or insurance repair, there shall be one week maximum rental charge from the day of mishap. Normal rental resumes thereafter and must paid prorate Wednesday.
   49. Car One Rentals does NOT PROMISE but will endeavour to provide a replacement vehicle, if your vehicle is taking longer than one week to return on the road, due to the following reasons:
   50. Car is getting repaired at the mechanic shop
   51. In the process of finalising insurance claim, due to right off
   52. The driver takes responsibility of any repair on the vehicle and he is required to take the car to a designated repair workshops for services such as;
   53. Mechanical fix
   54. Regular service and maintenance
   55. Insurance repair
   56. Wheel and tyres replacement alignment etc.
   57. It is driver responsibility to check OIL, WATER, Brakes, and Transmission Fluid as well any mechanical issues during course of rental agreement. Negligence is UNACCEPTABLE.
   58. It is expected that car will be in similar condition during the time of handover time with the exception of wear and tear resulting from long usage.
   59. If it is not possible to conduct an inspection of the Vehicle with you at the end of the Rental Period we will use our best endeavours to confirm the condition of the Vehicle with you within 4 working hours of the Final Inspection.
   60. Minor FIXES are driver’s responsibility e.g. lights, door pads, car charger or fuse replacement etc.
   61. Any flat tyre, flat battery, lost key, wrong fuel, empty tank or any act of negligence resulting to mechanical damage shall be the driver’s responsibility. Car One Rentals will carry out all maintenance on the vehicle as long it’s NOT caused by driver’s negligence and lack of care.
   62. If the car is due for servicing, the renter MUST notify us via mobile, email or online web contact form.
   63. If:
   64. A Warning light or fault message appears
   65. You see or become aware of low engine or brake oils, engine coolant levels or tyre pressures; or
   66. The Vehicle develops any fault during the Rental Period

   You must inform us immediately and not use the Vehicle unless we have authorised you to do so. You shall bear responsibility for any damage or third party loss on refusal to notify us on observing any of the above.

   35. You must not let anyone work on the Vehicle or arrange or undertake any repairs to the Vehicle or towing or salvage of it unless we have given you prior authority. You must keep and produce the original tax invoices and receipts for any repairs, towing or salvage and you shall be reimbursed only if these expenses have been authorised by us. Any entitlement to reimbursement is subject to there being no serious breach of the Rental Contract.

5. You must drive the car under non-suspended valid Australian License.
6. You shall not drive the car under the influence of Alcohol or drugs otherwise you will be liable for any charges caused by such act of negligence.
7. You are liable for and must pay:
8. Speeding and traffic fines, infringements and penalties arising from the use of the Vehicle;
9. Fines, infringements and penalties arising from parking, clamping, towing, or release of the Vehicle from compounds; and
10. All court fees or costs arising from sub-clauses (a) or (b).
11. Roads and Maritime Services ABN 76 236 371 088 (RMS) provides an E-toll facility for payment of tolls incurred by You when driving the Vehicle on a toll road and you must pay RMS in connection with Your use of the E-toll facility:
12. All tolls incurred in connection with your use of a toll road;
13. A service fee of $3.00 plus GST for each calendar day on which a toll is incurred using
14. Your E-toll facility (of which $1.50 plus GST is remitted to Us by RMS); and
15. Any other amount that is payable pursuant to the Roads and Maritime Services Terms and conditions
16. You must check fluids, tyres and any mechanical repairs required and notify Car One rentals staff.
17. You must keep the car clean and tidy.
18. You must take the car for maintenance when required.
19. You must sign Vehicle inspection form prior to vehicle collection.
20. You must notify Car One Rentals within 24hours after commencing rental and any issues or damages to the car.
21. You MUST contact Car One Rentals In the event of accident.
22. In the event of an ACCIDENT involving another party, you MUST take his/her complete details such as, license screen shot, full name, current address, mobile or work phone, and car details. Ensure to stay registered.
23. In the event of Emergency, where Car One Staff is not accessible, you must contact 000, or if Road Side assistance is required, you must contact insurance. Your insurer details will be listed in the rental agreement.
24. During the rental period you must take adequate care of the vehicle:
25. To Prevent Damage, theft of the vehicle and Third Party Loss
26. To ensure that the vehicle is not overloaded by the number of persons or by the weight of goods carried;
27. By using any security device fitted to or supplied with the vehicle; and
28. Taking steps to protect the vehicle against inclement weather such as closing the sunroof or convertible roof to prevent the entry of rain or where practicable, by garaging the vehicle to prevent damage caused by hail.
29. You must never :
30. Use the vehicle when it is damaged or unsafe;
31. Drive the vehicle whilst under the influence of alcohol or drugs or have a blood alcohol content or level of drugs present in blood, urine or oral fluid that exceeds the limit in the state or territory where the vehicle is driven;
32. Drive the vehicle whilst your driving licence is subject to any restriction or condition;
33. Drive the vehicle recklessly or in a manner that is likely to pose a real danger to you or members of the public;
34. Use the vehicle for off reading, reliability trials, rally , speed testing, driving instruction, to propel or towing another vehicle;
35. Use vehicle for any illegal purpose
36. Sell, rent or dispose of the vehicle
37. Register or claim to be entitled to register any interest in the vehicle under Personnel Property Securities Act 2009.
38. You and any passengers must not smoke in the Vehicle. It is an offence in some Australian states to smoke in a vehicle where there are passengers of less than 18 years of age. Additional charges will apply if there is a breach of this condition.
39. You must not leave the Vehicle unattended, without reasonable excuse, following an Accident and before the arrival of a tow or salvage operator
40. You must not use the vehicle for transporting any animals, other than Guide Dogs or other medically permitted assistance animals unless specifically approved by us. Additional cleaning charges may apply.
41. You must not drive the car on unsealed road, more than 500 meters, unless it’s for sole purpose of camping or official camping areas, and your speed should not be more than 40 KM/hour.
42. You must not drive the car through river, flood, or through fire where caution sign are issued.

At the end of rental contract period, in addition to your obligation in clause 1.6,1.7, you must return the vehicle to us;

1. To the designated location or where you picked the vehicle from
2. Subject to reasonable wear and tear, in the same condition it was in at the start of rental after making good any damage caused by the installation and removal of equipment installed for the operation of the vehicle for RideShare purposes.

The bond prepaid to us is fully refundable to you PROVIDED, at the end of rental period:

1. All amounts due to Us under the Rental Contract have been paid;
2. Vehicle has been returned to the Rental Station at the date and time set in the Rental Agreement;
3. There is no damage or third party loss;
4. The exterior and interior are clean;
5. The vehicle has full tank;
6. There has not been a serious breach of contract.
